What Do The Figures Reveal About Boise Real Estate?

The percentage of Boise home sellers who cut their asking price declined again in February and sellers made slightly smaller reductions in prices, real estate website Zillow.com said on Wednesday.

The median list price of homes, however, fell in January, sources said in a report, which was obtained by Reuters ahead of its scheduled release.

Nearly one in five homes, or 19.5%, listed for sale on the Zillow website had at least one price reduction as of the end of February, down from 19.8% in January, sources said.

Asking prices dropped by an average of 6.8% in January to an average reduction of 6.7% in February.

The Boise real estate market has posted this trend consistently over each of the past twelve months, showing a boon for buyers. The February home sales numbers did not look too hot either, considering Zillow reports that an 8.7% price drop was shown over 33% of listed homes.

The median list price of homes fell 1.4% in February from January, to $205,000, which is down 6.8% from the median listing price in February 2009, sources said.

The Boise real estate statistics continue to improve with the median day on market dropping from 109 in January to 105 days in February sources reported. The greatest reduction in the median days on market category was in August which posted only a median of 90 days on market.

In February 2009 the median time on the Boise real estate market was 109 days on Zillow.

What this means for many property owners is that the inventory is being absorbed at predictable rates that would allow for price changes accordingly. Many Boise real estate sellers will have to use this information to plan on reducing their prices to keep pace with the market as it continues to show a slow pace this winter sales season. If this is not taken into account you may find yourself in the unfavorable situation of trying to catch up on a declining market and use up all of your equity.

The trend today for many is to opt for Arizona foreclosure properties before looking at anything else, but new laws are resulting in thousands of litigation’s that are leaving many destitute and without a clear deed to the property they thought they were buying. With passage of Senate Bill 1721 in July 2009 and a revision enacted in September, many are finding themselves facing years of lawsuits and appeals in the hopes of straightening out the whole mess.

The original law contained many loopholes and failed to protect lenders. As a result, the revision sought to correct this deficit, but the result was a set of mandates that failed to clarify much of anything, but left many more questions. In order to try to protect the interests of lenders, the revision allowed liens to be placed on foreclosed properties in an attempt to ensure payment on the original loan, but the result was that those purchasing these structures faced years of struggle without the option of reselling in order to move on.

The original law had good intent in that it was designed to make it harder to foreclose on properties. However, a reinterpretation, as well as a few loopholes, allowed lenders to file what’s called a deficiency judgment in order to collect the difference between what they could collect on the sale and the amount that was owed. In essence, walking away from a property no longer negates the debt plus leaves new owners in a bind as even if they tried to resell, the lien would have to be paid off first, often for more than they could ever get.

Another issue was confusion about residency. Although the law had a residence clause, with the revision it didn’t matter if someone resided in the property or not, it could still be sold out from under them. This also affected those absent from the property while on an extended vacation (30 days or more) or in the hospital in which case the property could be seized and sold if a payment was missed. It was up to the homeowner to prove residency, which was more difficult than at first thought. Additionally, this new revision did not explain whether all loans fell under these mandates or only those who were purchased after September 2009.

It is estimated it will take several years in appeals courts before clarification is received. In the meantime, lenders are becoming ever cautious about what to do with the many foreclosed properties on the market for fear the courts will come back and repeal any deficiency orders leaving lenders in financial ruin and confused as to what to do with property that had been resold, but was held by the courts under lien. This puts new buyers in a precarious position as well, as they may eventually lose the purchased property through no fault of their own.

The concern that those who default on a loan and lose the property in a foreclosure sale may still owe for the original amount of the loan, is making many reconsider this option and lenders ever more leery of taking on new mortgages. Most problematic is what happens to new buyers? Legally, does that mean that the lien placed on the property is forever if the debt is not repaid and what happens if they choose to resell, do they have to pay off the previous debt first?

The cost of a good defense attorney is high, but it is these people who will fight in the courtroom to decide the fate of the foreclosure market. This may mean not only those losing a home, but new owners as well may be required to fork over hard-earned money to ensure that their rights are protected. All of this can be avoided, however, if one is aware of what they’re getting into prior to making a commitment.

Many questions arise when one is dealing with an issue beyond their expertise. The legal system, real estate agents, lenders, and especially those with property or thinking about buying property are all confused as to how new legislation will impact the Arizona foreclosure market.
